Sopinka J. -- I have had the advantage of reading the reasons of my colleague Justice McLachlin but while I reach the same result I disagree with her application of s. 686(1)(b)(iii) of the Criminal Code , R.S.C., 1985, c. C-46 , with respect to the failure of the trial judge to make findings on the question of necessity.
