Regulations made under subsection 338(1) may extend, if they so state, to any ship as defined in Part XV, but in no case does a regulation made under subsection (1) apply to ships capable of engaging in the drilling for, or the production, conservation or processing of, oil or gas unless the regulation so states and was made on the joint recommendation of the Minister and the Minister of Natural Resources.
