    In a prosecution for an offence under subsection (3.1), it is sufficient proof of the offence to establish that it was committed by an employee, acting within the scope of their employment, or by an agent or a mandatary of the accused, acting within the scope of their authority, whether or not the employee or agent or mandatary is identified or proceeded against.
