980136 — DESIGNATION OF GEOGRAPHIC AREAS, DELIVERY AGENTS AND DELIVERY PARTNERS, O. Reg. 136/98

s. 1

(1) The territories, as constituted from time to time, of the municipalities and district social services administration boards set out in Column 1 of Schedule 1 are designated as geographic areas, and the Ministry is designated as the delivery agent for each of those geographic areas.

s. 1(2)

For each geographic area set out in Column 1 of Schedule 1, the entity set out opposite in Column 2 is designated as the delivery partner.

s. 2

The territories, as constituted from time to time, of the lands designated under the Indian Act (Canada) as the reserves of the bands set out in Schedule 2 are designated as geographic areas and those bands are designated as delivery agents for those reserves. ;

s. 2.1

(1) The territories, as constituted from time to time, of the lands designated under the Indian Act (Canada) as the reserves of the following bands are designated as a geographic area:

(1) The territories, as constituted from time to time, of the lands designated under the Indian Act (Canada) as the reserves of the following bands are designated as a geographic area:

The corporation known as the “Stepping Stones Support Services Program” is designated as the delivery agent for the geographic area designated in subsection (1).

s. 2.3

The territory as set out in the document labelled “Description” dated June 27, 2011 published by Natural Resources Canada with file reference SM8206 - 06356 and available from the Ministry is designated as a geographic area and the band known as the Nibinamik First Nation is designated as the delivery agent for that geographic area. ;

s. 2.4

The territory, as constituted from time to time, of the lands designated under the Indian Act (Canada) as the reserve of the Ojibway Nation of Saugeen is designated as a geographic area and Mishkeegogamang is the band designated as the delivery agent for that geographic area.

s. 2.5

The territory, as constituted from time to time, of the lands designated under the Indian Act (Canada) as the reserve of the Chapleau Cree First Nation is designated as a geographic area and Brunswick House is the band designated as the delivery agent for that geographic area.

s. 2.6

The territory, as constituted from time to time, of the lands designated under the Indian Act (Canada) as the reserve of the Slate Falls Nation is designated as a geographic area, and the Slate Falls Nation is the band designated as the delivery agent for that geographic area.

s. 3

The territory, as constituted from time to time, comprising those parts of the territorial districts under the Territorial Division Act that are not included in a geographic area under section 1, 2, 2.1, 2.2, 2.3, 2.4, 2.5 or 2.6 is designated as a geographic area and the Ministry is designated as the delivery agent for that geographic area. ; ; ;

s. 4

(1) A delivery agent may enter into an agreement under section 45 of the Act giving another entity authority to determine eligibility for assistance only if,

s. 4(1)(a)

the other entity is another delivery agent, a delivery partner, a municipality, a band, a district social services administration board or the aboriginal tribal council known as the “Kenora Chiefs Advisory Inc.”;

s. 4(1)(b)

the agreement requires the entity to comply with any duties of the delivery agent under the Act with respect to that authority; and

s. 4(1)(c)

the agreement authorizes the delivery agent to cancel the agreement if the entity does not comply with those duties. ;

s. 4(2)

If the Ministry is the delivery agent in a geographic area, the limitation set out in subsection (1) does not apply.

s. 5

Each delivery partner is authorized to perform the powers and duties of an administrator that relate to the administration of the Act and the provision of assistance in the delivery partner’s geographic area, except for,

s. 5(a)

powers and duties relating to appeals to Divisional Court; and

s. 5(b)

the power under section 46 of the Act to delegate the administrator’s powers and duties to employees of a delivery agent.

s. 6

(1) Subject to subsection (2), a delivery partner may enter into an agreement with regard to any matter relating to the performance of the delivery partner’s powers and duties in the delivery partner’s geographic area.

s. 6(2)

A delivery partner may enter into an agreement giving another entity authority to determine eligibility for assistance only if,

s. 6(2)(a)

the other entity is another delivery agent, a delivery partner, a municipality, a band, a district social services administration board or the aboriginal tribal council known as the “Kenora Chiefs Advisory Inc.”;

s. 6(2)(b)

the agreement requires the entity to comply with any duties of the delivery partner under the Act with respect to that authority; and

s. 6(2)(c)

the agreement authorizes the delivery partner to cancel the agreement if the entity does not comply with those duties.

s. 7

(1) Each delivery partner shall provide to the Director information relevant to the performance of its powers and duties under the Act that is requested by the Director, including information about present and former applicants and recipients under the Act, the Ontario Disability Support Program Act, 1997, the Family Benefits Act or the General Welfare Assistance Act.

s. 7(2)

The information shall be provided in the form and manner requested by the Director.

s. 8

(1) Information collected by a delivery partner for the purposes of the Act may be used by the delivery partner and the delivery agent for the purposes of and in accordance with the Act.

s. 8(2)

Personal information collected by a delivery partner for the purposes of this Act may be used by the delivery partner and the delivery agent only for the purpose for which it was collected or for a consistent purpose or as authorized under the Act.

s. 8(3)

Each delivery partner shall keep information collected under the Act in the form and electronic system required by the Director.

s. 9

Each delivery partner shall be subject to the powers of the Director set out in section 48 of the Act.

s. 10

(1) Each delivery partner may establish a local fraud control unit.

s. 10(2)

Subsections 57 (3) and (4) of the Act apply to a local fraud control unit established under subsection (1).

s. 11

Each delivery partner is,

s. 11(a)

responsible for the payment or provision of discretionary benefits in the delivery partner’s geographic area in accordance with subsection 57.2 (3) and section 59 of Ontario Regulation 134/98 (General) made under the Act; and

s. 11(b)

entitled to recover amounts in accordance with subsection 59 (5) of Ontario Regulation 134/98.
