Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:—

s. 1 — Personal community charges: substituted amounts.

s. 1(1)

In the Local Government Finance Act 1988 (the 1988 Act) section 35 (duty to set substituted amounts for personal community charges) shall be amended as mentioned in the following provisions of this section.

s. 1(2)

In subsection (3)—

s. 1(2)(a)

in paragraph (c) for the word “other” there shall be substituted the word “ qualifying ” and after the word “above” there shall be inserted the words “ or under this section ”;

s. 1(2)(b)

paragraph (d) shall be omitted.

s. 1(3)

The following subsections shall be inserted after subsection (3)—

s. 1(4)

In subsection (5)(c) after the word “any” there shall be inserted the word “ qualifying ” and after the word “above” there shall be inserted the words “ or under this section ”.

s. 1(5)

The following subsections shall be inserted after subsection (5)—

s. 1(6)

In subsection (8) the words from “and in construing” to the end shall be omitted.

s. 2 — Substituted amounts: interpretation.

The following section shall be inserted after section 35 of the 1988 Act—

s. 3 — Substitutions: maximum amounts.

The following section shall be inserted after section 35A of the 1988 Act—

s. 4 — Multiple substitutions.

The following section shall be inserted after section 35B of the 1988 Act—

s. 5 — Further amendments, and repeals.

s. 5(1)

Section 36 of the 1988 Act (substituted amounts: supplementary) shall be amended as mentioned in subsections (2) and (3) below.

s. 5(2)

In subsection (1) for the words “amount for which it is substituted (the old amount)” there shall be substituted the words “ old amount ”.

s. 5(3)

The following subsection shall be inserted after subsection (3)—

s. 5(4)

In section 107(4)(a) of the 1988 Act the words “to (3), (5) and (8)” shall be omitted.

s. 5(5)

The enactments mentioned in the Schedule to this Act are repealed to the extent specified in column 3.

s. 6 — Application of amendments and repeals.

s. 6(1)

This Act applies in relation to the financial year beginning in 1992 and subsequent financial years.

s. 6(2)

This Act also applies in relation to the financial year beginning in 1991, but in accordance with subsections (3) to (5) below.

s. 6(3)

Sections 1 to 3 above apply where an authority sets an amount or amounts under section 35 above—and section 5(4) and (5) above and the repeals in the Schedule to this Act apply accordingly.

s. 6(3)(a)

for the financial year beginning in 1991, and

s. 6(3)(b)

after the day on which this Act is passed;

s. 6(4)

Section 4 above applies where—

s. 6(4)(a)

the duties concerned relate to the financial year beginning in 1991, and

s. 6(4)(b)

the time concerned falls after the day on which this Act is passed.

s. 6(5)

Subsections (1) to (3) of section 5 above apply where the new amount is set—

s. 6(5)(a)

for the financial year beginning in 1991, and

s. 6(5)(b)

after the day on which this Act is passed.

s. 6(6)

A financial year is a period of 12 months beginning with 1 April.

s. 7 — Citation and extent.

s. 7(1)

This Act may be cited as the Community Charges (Substitute Setting) Act 1991.

s. 7(2)

This Act extends to England and Wales only.
