UKPGA-2021-16 — Education and Training (Welfare of Children) Act 2021

Be it enacted by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:—

s. 1 — Welfare of children: 16 to 19 Academies and further education

s. 1(1)

The Education Act 2002 is amended as follows.

s. 1(2)

In section 16 (terms on which financial assistance under section 14 is given), in subsection (1), for “subsection (2B)” substitute

s. 1(3)

In section 175 (duties of local authorities and governing bodies in relation to welfare of children) after subsection (3) insert—

s. 1(4)

In subsection (4) of that section—

s. 1(4)(a)

for “An authority or body” substitute “ A person ”;

s. 1(4)(b)

for “(3)” substitute “ (3A) ”.

s. 1(5)

In subsection (5) of that section, at the appropriate place insert—

s. 1(6)

In the heading of section 175 omit “of local authorities and governing bodies”.

s. 2 — Welfare of children: apprenticeships and technical education

s. 2(1)

The Apprenticeships, Skills, Children and Learning Act 2009 is amended as follows.

s. 2(2)

In section 101 (financial resources: conditions), in subsection (1), after “conditions” insert “ , subject to section 101A ”.

s. 2(3)

After section 101 insert—

s. 3 — Extent, commencement and short title

s. 3(1)

This Act extends to England and Wales only.

s. 3(2)

This Act comes into force at the end of the period of two months beginning with the day on which this Act is passed.

s. 3(3)

This Act may be cited as the Education and Training (Welfare of Children) Act 2021.
