If in any action or proceeding a question arises as to whether a particular instruction or direction mentioned in subsection (2) was broadcast to a ship by the Canadian Coast Guard, a certificate purporting to be issued by or under the authority of the Secretary of the Department of Transport appointed under the Department of Transport Act containing all of the following facts, namely,
